Subject : H & FW Deptt, GNCT of Delhi trashes Financial Rules & Govt. Orders

Respected Sir,

It is for your kind information and needful action that Violation of Financial Rules and Govt. Orders are now become habit in H & FW Deptt, GNCT of Delhi. The seed of corruption sowed by Sh. S.C.L. Das as Secretary in H & FW Deptt become huge tree of corruption. The caretaker of this corruption tree is again the same officer Sh. S.C.L. Das who is now most powerful person in Delhi Administration being Secretary to Hon'ble Lt. Governor. Therefore same custom is continued by other authorities in H & FW Deptt because they all know that their caretaker will definitely take care of them for their all criminal activities and they will be protected & enjoy their post.

Since No action has been taken in exposed corruption cases. This is continuously increasing courage of other authorities to violate Financial Rules and Govt. Orders. No action is only because that the competent authorities themselves like Sh. S.C.L. Das, etc are found indulged in corruption cases.

God bless them but I will continue to expose the corruptions and financial irregularities came to my knowledge being Whistle blower and considering my moral duty for the country.

Addl. Secretary, Dr. R.N. Das of H & FW Deptt, GNCT of Delhi has issued an ORDER F.No.7/31/2009/CD112147690/H&FW/SAG/Pt. File/893 dated 30-03-2016 regarding Reorganization of Health Care System in Delhi. This order states Under Para (3) Delegation of Financial Powers that All Medical Superintendents will continue to use their financial powers as HOD, however, the proposals having financial implications of Rs. 5 Lakh and above will be sent to RDHS for Administrative Approval before the financial powers are exercised by them. This issues with the prior approval of Competent Authority.”

However, OFFICE MEMORANDUM No. F.8/3/2010-AC/usfa/41-44 dated 12-03-2015 issued from Finance (Accounts) Department, GNCT of Delhiregarding Delegation of financial powers to HOD and Administrative Secretaries of the Departments of GNCT of Delhi, at S.No. 23(C) Purchase of Medical stores and Equipments; FULL POWER” assigned to Head of Departments i.e. Medical Superintendents of the Hospitals.

This ambiguous Order of Addl. Secretary (H&FW) is raising eyebrows towards a huge Financial Criminality due to following reasons:

  1. Who is the competent authority in H & FW Deptt modified Financial power of HODs and overruled Delegation of financial power issued by Govt. of India?

  2. When Full Financial Power assigned to HODs by Finance (Accounts) Department then from where H & FW Deptt imposed ceiling of Rs. 5 Lakh?

  3. Now, Administrative Approval will be given by RDHS (Regional Director Health Services) for each purchasing of hospital equipments above Rs. 5 Lakh whereas Expenditure Sanction will be given by M.S. Of concerned hospitalsagainst the Finance Rules.

  4. How the competent Authority of H & FW Deptt found RDHS (SAG Cadre)most competent OR Knowledgeable to give A/A (Administrative Approval) alone in comparison to M.S. (SAG Cadre) for the items above Rs. 5 Lacs whereas decision should be taken by a committee (previously decided by EPC i.e. Equipment Procurement Cell) not by a single officer except Secretary.

  5. Addl. Secretary (H&FW) circulated this order copy to Hon'ble Lt. Governor, CM, Dy. CM, Secretary to Hon'ble Health Minister, PS to Secretary H&FW, All Sp. Secretaries, All regional Directors, All Addl. Secretaries/Jt. Secretaries/ Jt. Directors of H&FW, All Dy. Secretaries of H&FW, All M.S./Directors of Hospitals and Guard File.

  6. MOREOVER, Order copy dated 30-03-2016 issued by Addl. Secretary, Dr. R.N. Das (H&FW) has not been marked to Chief Secretary of Delhi and Pr. Secretary, Finance.

  7. Why Order copy not given to Chief Secretary of Delhi and Pr. Secretary Finance of GNCT of DelhiWhy both most important Senior Administrative Authorities are by passed?

Yeh chori chori Rules violate karke Health System Reorganization kyon kiya ja raha hai?

It is not the end of this case. On other side, Director CPA DHS (Central Procurement Agency of Directorate of Health Services) without having Financial Powerordering all M.S. of Hospitals to send their demand of equipments to him for procurement from CPA. It is important to mention that CPA procures all the items and Bills for the same are also passing by CPA.

NOW, Please let me know, Where is “FULL POWER” of M.S. exists? Whether M.S. of Hospitals should procure equipments through their own Financial Power OR send the demands to CPA (having NIL Financial Power) OR send file to RDHS (having NIL Financial Power) for approval?

SUMMARY

  1. Govt. of India provided full power to HOD for Purchase of Medical stores and Equipments and the same is endorsed by Finance (Accounts) Department, GNCT of Delhi.

  2. Addl. Secretary, Dr. R.N. Das (H&FW) issuing order to HODs to execute modified Financial Power with keeping Chief Secretary and Pr. Secretary Finance, GNCT of Delhi in dark and not informed them about this modified Financial order.

  3. On other hand, Director CPA DHS, Dr. Vijoy Kumar having NO FINANCIAL POWER ordering HODs to submit their equipment demands to him so that he can do procurement.

CONCLUSION

  1. Either the competent Authorities of H & FW Deptt, GNCT of Delhi are really illiterate, don't know the administration and not aware with Finance Rules/Govt. orders OR they are willingly doing violation of Financial Rules and Govt. Orders.

  2. If the authorities of H & FW Deptt are not illiterate and well qualified then there is no reason for violation of Rules except CORRUPTION.

  3. There is extreme need for scrutinizing the competency of authorities holding higher post in Administration, needs extra training before posting at responsible posts so that they can serve their best services to people of Delhi and essential for smooth functioning of H & FW Department.

  4. High level enquiry should be conducted under Prevention of Corruption Act, CCS (CCA) Rules 1965 against the authorities of H & FW Deptt including Sh. S.C.L. Das.

PRAYER

I request you sir to please do your kind intervention in this matter otherwise authorities of H & FW Deptt will drain whole Delhi into gutter and the end results will be Disastrous for the people of Delhi especially in Health Care System.
