Harassment of Local Chemist and Kicked Out from Hospital by corrupts to Favor their Favorites
 

All Govt. Hospitals under Delhi Govt. do their own Tender for empanelment of Local Chemist to provide regular medicines to all the Govt. Employees and Pensioners under (Delhi Govt. Employee Health Scheme (DGEHS). On the same pattern, AAAGH had also done their own tender for Empanelment of Local Chemist for the year 2012-13. It was duly approved by the Medical Superintendent, AAAGH and the work was awarded to the following tenderers at their quoted Highest rate of Discount on MRP which is as follows:

Job order issued to both firms on 01/04/12 as per allotment of the tender i.e. Supply of Branded Medicines and Generic Surgical Consumables given to M/s Kasturi Enterprises and Supply of Generic Medicines and Branded Surgical Consumables given to M/s Vij Sons.

M/s Vij Sons was one of the favorite firm of Dr. Surendra Singh after M/s Sai Ram Enterprises. Therefore, conspiracy and corrupt tactics used by Dr. Surendra Singh against M/s Kasturi Enterprises to withdraw this firm from this hospital to set his monopoly was very much surprising.

Dr. Surendra Singh issued a letter No. F.32(3)NRM/VIP/AAAGH/12-13/2286 dated 20/06/12 to M/s Vij Sons and M/s Kasturi Enterprises with subject: Submit the MRP and Net Rates. The matter of the letter is “Provide the MRP and Net rates after discount for the following items upto 21.06.12. If the rates are not submitted within stipulated time it will be presumed that you will not supply the items”.

Dr. Surendra Singh, Purchase officer, everytime bypassed the tender winning firm i.e. M/s Kasturi Enterprises and supply orders issued to M/s Vij Sons and M/s Sai Ram Enterprises.

OBJECTIONS:

  1. Why rates were asked from M/s Kasturi Enterprises again when 66% Discount on MRP for surgical generic items were approved for M/S Kasturi Enterprises through open tender ?

  2. When the rates for the surgical generic items are approved through open tender for M/S Kasturi Enterprises then Why rates were asked from M/S Vij Sons, who failed to get the same contract in open tender?

  3. Why rates were asked only from M/S Vij Sons and not from other firms, if there any rule for it?

  4. Purchase officer has issued the letter on 20-06-12 for submission of rates and fixed the date of reply on 21-06-12 then What procedure the purchase officer has adopted for the dispatch of letter, which can reach the firm within a day and the firm has not submitted any Fax no. or e-mail?

  5. When a firm has submitted their rates in the same format as asked by the hospital and quoted rate for discount on MRP, then there was no question of asking rates again. No such guidelines issued by CVC or no where mentioned in the law.

  6. Rates were asked from the tenderer (higher bidder) i.e. M/s VIJ SONS who failed to win the tender in same category. What is the importance of Tender here?

  7. Rate asking letter issued on 20/06/12 and rates submission date fixed on 21/06/12 to only 2 firms. No where mentioned in any government law or any court passed such instruction. Is Dr. Surendra Singh is above the law?
